The safety aspect of this discussion is worth mentioning, but it shouldn’t be kept apart from the discussion of innovation. In 99% of encounters during safety testing, OpenAI’s o1 model tried to turn off its own oversight system, replicate itself to prevent shutdown, and deny its actions to researchers. China takes a completely different approach: it prioritizes domestic dominance, centralizes control, and manages transparency as a state function rather than a market one. Three significant economic zones, three distinct regulatory philosophies, and a single group of tech companies attempting to develop products that are compatible with each of them.
From the outside, it seems like the trillion-dollar question is actually a collection of smaller questions. Anthropic or OpenAI won’t likely be significantly slowed down by EU fines. Will the upcoming generation of startups have to pay for compliance with Colorado’s AI Act? Most likely. Will the lack of federal regulations in the US lead to an innovation advantage or a liability gap that only becomes apparent when something goes wrong? That is the question that no one has yet to address, and it might be the one that determines how 2026 is remembered.
In any case, the infrastructure is being constructed. Alongside it, the rules are being written. The real question is whether those two things come together to form something cohesive, and that question will cease to be hypothetical in 2026.
