The most influential CEOs in Silicon Valley are discreetly making time in their calendars. Not for new product announcements or stock calls, but for what is likely to be the decade’s most significant policy conflict. Once a footnote in Silicon boardrooms, regulation is suddenly on the agenda.
An important turning point was the implementation of the European Union’s AI Act in early 2025. With clauses prohibiting “unacceptable risk” applications of AI, such biometric scoring or manipulative algorithms, the new regulations attack the tech titans where it hurts: in their ambitions for international expansion and business models.
The law’s ambition and its pointed fangs were what startled CEOs, especially those at Meta and OpenAI. The maximum penalty is €35 million or 7% of worldwide sales, whichever is greater. That might amount to billions for certain businesses.
The Act, according to Mark Zuckerberg, “institutionalized censorship.” Joel Kaplan, his policy chief, even went so far as to warn that if EU regulators were too aggressive, Meta may seek U.S. executive involvement.

The first deadline fell in early February. For employees working on system development, AI literacy has become a must. This seemingly simple rule exposed a more significant reality: AI rules are no longer theoretical. They are here, quantifiable, and enforceable.

Remarkably, Governor Jared Polis of Colorado also requested federal assistance. He pleaded with Congress to establish a national framework in place of the disarray of state-by-state regulations. Many saw his request as a grudging acknowledgement that things were getting out of control, coming from a leader who signed the state’s hallmark measure.
It appears that the White House concurs. The 2025 draft executive order from the Trump administration adopts a very assertive posture. It gives the Department of Justice the power to legally challenge non-compliant laws and suggests withholding federal assistance from states with “burdensome” AI regulations.
It has a clear goal and is a financial hammer dressed in policy rhetoric.
The task of creating a minimally invasive standard would go to federal agencies such as the FTC and Commerce. Meanwhile, leaders like James Braid and David Sacks are being called upon to draft legislation that effectively centralizes control of AI under Washington’s purview.
There are internal critics of this campaign. Senator Josh Hawley and other Republicans claim that this violates states’ rights. “To say that the states should do nothing is a strange argument,” he said during a press briefing.
However, it appears that Silicon Valley favors national clarity. 250 CEOs recently came together as part of an Alliance to voice their concerns over contradicting legislation; some of the participants likened complying with AI regulations to crossing “a minefield blindfolded.”
Even though they are usually more modest, IBM and Microsoft have underlined the need for a single policy. They desire stability and trust, but they support rules. Their stance is in line with a more general business perspective, which holds that properly implemented AI regulation can be an advantage over competitors.
On the other hand, Anthropic is in favor of robust national security and safety measures. The “move fast and don’t ask permission” mentality that formerly characterized the Valley is radically different from their strategy.
The small and medium business community is facing a silent crisis as the discussion heats up. Less than a third of SMBs feel sufficiently prepared, and almost 65% are worried about managing AI policy, according to the U.S. Chamber of Commerce.
For marketing, scheduling, payroll, and even legal drafting, these businesses frequently use generative AI. However, they are most likely to be caught off guard in the absence of legal teams or compliance specialists.
AI is a two-edged sword for startups in particular: it’s essential for survival, but its implementation is becoming more and more dangerous. A compliance error could end up costing more than any initial fundraising round.
And China is next. China continues to implement a centrally planned AI policy as the United States and Europe argue over frameworks and enforcement agencies. In private, many U.S. executives worry that regulatory fragmentation may cause years or perhaps decades to pass before American progress is made.
It isn’t exaggerated. Without a federal rule, state-by-state compliance could cost more than $1 trillion over ten years, according to an analysis by the Information Technology & Innovation Foundation.
Consolidation makes logical sense. Federal authorities may lessen legal barriers, enable speedier time-to-market for innovation, and drastically save costs through strategic harmonization.
However, the question of who makes the decisions about what is safe and for whom remains unanswered.
European civil society organizations have already charged their own politicians with caving in too easily to pressure from the internet industry. Concerns are mounting in the United States that a Trump-led national strategy may lean too much in favor of deregulation, endangering workers and consumers.
